I wouldn't mind so much if I hadn't named the Act, (ok so I called it the Sex Act because I couldn't be bothered to type the full name but it's easy enough to find!).
If I'd just said yes there is legislation and someone else had said no there isn't, that's different.

It isn't covered by the voyeurism law. To be voyeurism is has to be done for the sexual gratification of someone.
I can't think of a law that would make it illegal but I'm not a lawyer. I know this law because I'm studying it.
I posted more detail on the thread in question, from the CPS guidelines.
It's not very nice to not warn people if they're being filmed though. |

OP you're 100 % correct filming people having sex etc has to be with consent all round. I know this for a fact as I've done it myself, with their consent and they are friends not strangers.
Good quality smartphones these days makes it relatively easy for people to abuse the laws, people engaged in sexual activity are not the most aware at the time.
If someone says they're recording it for their own use that could be true but it's not recommended.
Voyeurism seems to get a bad name for all the wrong reasons it's incidents highlighted by the OP that are common.
It's all about consent at the end of the day, some people will always be open to manipulation though sadly. |

Section 67 does indeed require the reason to be for sexual gratification, either for the person filming/installing the equipment or a third party.
As long as you have evidence of the filming/equipment, a witness stating they did not give permission, evidence of the 'private act' then it will be open to the court to decide on whether the circumstances as a whole were done for a sexual purpose. |

Before the 2003 sexual offences act it wasn't illegal at all.
I know of one young female who worked for an airline company and stayed at her friends house and discovered her friends dad had rigged the bedrooms and bathrooms with hidden cameras
She got the fright of her life...nothing could be done to him though as it wasn't illegal then. |
