Ok, so I've seen a load of profiles where at the end of the profile, people write

"You do not have permission to share or use my pictures......"

"Fabswingers is now a publicly traded company, you do not have permission to use my pictures....."

Some of them quote some law,

And some of them are longer than the actual part describing themselves.

The Law that's quoted, its saying no one can use your PRIVATE information...

No one can look at your Private emails, no one can go into your PRIVATE home and read PRIVATE letters...

As soon as you choose to put any information, or pictures, in a Public forum, then that information, or pictures, are no longer private and anyone, or any company (eg. Fabswingers) can use them however they like.

Now matter what you put on your profile, Fabswingers could still take your photos and use them I'd advertisements if they wanted to and they would not need your permission. You have given your permission as soon as you made them public.

Seen it yr and yrs by, I think I was told that people would have to state that on the profile so anyone, reporters etc that may use the content or pictures of the profile were not allowed to as the user has been very clear to the point of noone has any rights or permission to use the information or to use the verification information or not to contact the relevant person or publicise print report or any other uses study material 🤔

I "love" those disclaimers. Especially if 90% of the profile is that stuff.

Those things are utterly useless. More than useless - knitted condom level of useless. A waste of pixels and bytes. As a user you are bound by the website’s T&Cs, not by whatever legal fan fiction someone decides to copy into their profile. If you dont accept the T&Cs you cannot use the site. Similar disclaimers were posted 15 years ago by grannies on Facebook and somehow people still fall for this.

Also, half of the time they are just garbled copy-pasta from somewhere else. Some dont even change the original site name.

My toenails curl every time I see “Fab is now a publicly traded entity”. Its only written at the bottom of every fab page that Fab is Winchester Consulting LTD(!!).

Also also, Sydney University doesn’t care about your sexy selfies. And if they did care, no amount of made up legal fan fic would stop them.

PS. I would like to retract my statement about knitted condoms being utterly useless - On second thought I imagine they are actually nice and cosy in the cold winter months As long as you take them off prior to sex that is.

I don't think it's QUITE as cut and dry as that. Even if pics are shared on a public forum that doesn't give everyone the right to do anything they want with them. For example sharing intimate pics of someone else without their consent is a crime.

But yeah the warnings, they don't have any legal standing. I guess the idea is they let any wannabe bad person that the picture owners are aware of their rights, but in reality a copy and pasted warning doesn't warn anyone of anything much.

That's because they are private pictures, where the person on those pictures, only gave 1 person permission to see them pictures.

As soon as you put pictures on your profile, then you are giving everyone permission to see them.

I don't think anyone is saying that these people don't want other members to see pics they put on their profile. The problem is when people download the pics and uses them elsewhere. If they don't have permission to do that then this is sharing intimate images of others which is a criminal offense.

Not if those pictures are public pictures...

Sharing private pictures without consent is a crime but putting your pictures in a public forum is giving consent and also doesn't make them private anymore.

It's like if you put intimate pictures of yourself on Facebook, Facebook can do whatever they like with those pictures, and so can anyone else (unfortunately).

You putting your photo in public, is giving permission, you might not actually say the words, but it's doing it so it's not sharing pictures with consent

I'm not saying it's right, I'm just saying that's how it works...

Huge difference between private pictures and public.

This is incorrect.

Even on a public site, you still keep your copyright and data protection rights.

Posting something publicly doesn’t mean you’ve given consent for anyone to copy, download, or repost it elsewhere.

Under Irish law sharing intimate images without consent is a criminal offence regardless of where the original was posted.

Fab is granted a 'limited licence' to display the images but that's it.

The law doesn't make a distinction between private pics and those you have shared elsewhere already. If you are sharing an intimate pic of someone without their permission, and they report you, then its a crime and you can be prosecuted for it.

I've met and played with solicitors and they had something similar on their profiles on different sites in different languages too, so there must be something in it
