A difficult day for anyone not cis male, sort of… I understand the strength of feeling about gender identity but today’s Supreme Court ruling seems regressive. Not only did it make it a default for “single sex” spaces to exclude trans people but it also defined, in law, who can be called a lesbian.

Worth (re)stating that a large amount of the time it is men who commit physical and sexual abuse. Trans people can be disproportionately victimised.

I suspect people will post some different points of view, and maybe write something unpleasant in response…. I just wanted to say:

Sending solidarity to trans+ friends and anyone who feels threatened by this ruling.

To be clear: I am in no way saying women shouldn’t feel safe or have separate spaces where they don’t feel scared, I think it’s sad that the debate gets figured as a zero sum game where others have to be denied that same consideration.

That statement of not affecting trans rights reads about as true as starting a sentence with "Not to sound racist, but..."

By basically removing the gender recognition act several protections are now removed from people who still need them.

And it's perfectly clear from comments on threads around here that it's been a real rallying cry for transphobes and bigots.

I respectfully disagree in all counts.

It states an oversimplified version of biology that is not reflected in current scientific understanding. Indeed the Court simplistically defines ‘biological sex’ as “the sex of a person at birth”. This means, presumably, sex as initially recorded on one’s birth certificate - a matter of documentation and presumption, rather than actual biology.

The deliberation was skewed. The judgment goes out of its way to give special thanks to Ben Cooper KC - acting on behalf of Sex Matters, who were allowed to intervene in the case - stating that he “gave focus and structure to the argument” that sex should be given its ‘biological meaning’. Cooper has previously acted on behalf of gender critical activists Maya Forstater and Allison Bailey. No trans people were allowed to give evidence before the court.

The decision seems to make it lawful to exclude trans people from single-sex spaces, under any circumstances. Previously, it was thought that to exclude trans people from a single-sex space, the exclusion had to be shown to be a proportionate means of achieving a legitimate aim. Now, the exclusion is automatic for trans people trying to access a space which does not coincide with their ‘biological sex’ (sex assigned at birth).

Instead, the Court explains that the exclusion is intended to additionally prohibit trans people from accessing spaces aligned with their ‘biological sex’.

This lets anti-trans activists have their cake and eat it too, forcing trans people out of public life.

In terms of Equalities law, the Supreme Court claims that this ruling does not lessen trans people’s rights. Trans people can still claim discrimination based on the protected characteristic of gender reassignment, regardless of their sex.

The Court also states that whilst trans women can still be protected from discrimination based on sex, on the grounds of perception. That is, that whilst they are considered male for the purpose of the Act, they can still be discriminated against by someone perceiving them as female.

This does, however, raise the possibility of a defence that your discriminator knew you were ‘biologically male’, so they couldn’t have been perceiving you as female. However, it is likely that this claim could then be framed as discrimination based on gender reassignment.

More worryingly, the Court acknowledges that this removes Equal Pay Protection from trans women with a Gender Recognition Certificate, who will no longer be able to claim that they are being underpaid compared to male colleagues.

However, the Court justifies this on the basis that the right is simply being transferred to a different group of trans people - trans men with a Gender Recognition Certificate - who will now be able to bring such claims against male colleagues. This is even though trans women remain significantly underpaid, even more so than their cis female colleagues.

The problem is not the Judgement (from what parts of it I have read), which is a a thorough, reasoned analysis of the statute but rather the agendas of people who seize on it to vindicate their own unreconstructed world view.

The judiciary can only be concerned with the correct legal interpretation. It is our elected representatives who have to ensure that the law reflects the wishes of society. If they are unhappy with how the Equality Act has been interpreted, I would expect them to repeal it.

Maybe I misread the judgement but I never saw the supreme court call trans women men.

They made a judgement that the equality act is referring to Cis women when it states women.

Anyone from any gender group can be paedophiles, murderers, gang members whatever. The issue I had was that allowing trans women to use women's toilets and changing rooms is opening up a potential loophole. Oh its alright I'll just pop on a wig and a dress, say I'm trans and I can get into public toilets and changing rooms used by children.

I'm all for people having rights to identify how they want, but vulnerable members of the public should always be at the forefront of decisions like this. And for that view, I don't apologise.

Hopefully one day, we can all get along. Noone will care about genders, religion, race, colour, sexuality, disabilities etc etc etc.

It's all a distraction from wider issues.

This gets all the attention with the media, it says big topic in the HoC.

Then they low slip in some laws that make life for everyone that little bit more shit, but makes rich people even better off.

They've been using things like this to distract the public for years.

The next big topic will be UKIPs "NET STUPID ZERO".

My elderly mum has never left the women's toilets and felt scared on Transwomen. In fact she would probably enjoy speaking with them cos she's a nosey git and will all sorts of personal questions 🤣

One of the safest clubs to have a night out are the LGBT+ clubs... It's not the security that make it safe, it's the mentality of the vast majority of people that attend.

Anyone who sees this a "victory" for society. You believe the next big topic, and the one after that and so on.

I bet in some places in the UK people still don't want to share spaces with coloured people. Let's see how many join that cause then scream for Victory if that comes to fruition.

In short, People in general are happier together. Society moves forward together, life improves for all.

You know how the The Hippocratic Oath has a condition of non-maleficence (doing no harm) ?

I personally believe decisions like this made by the Supreme Court should should also go through a similar filter.

It's clear to me that the ruling does harm. Which I why I cannot in good conscience support it.
