a jaffa cake is in fact a cake and not a biscuit.

HMRC took mcvities to court as they could of taxed jaffa's in they were declared a biscuit due to the chocolate on them.

Digestive biscuits are tax from but chocolate digestives are taxed.

But the test to prove if jaffa cakes are cake or biscuit is to leave one of each out in open, a biscuit will go sofy whilst a jaffa cake would go hard
